Upcoming hearing / lawsuit - is it a good idea to be posting / blogging, prior to the conclusion ?

Interesting question.

Most lawyers will say no, no, no....... and again, no.

When large sums of money are at stake, the general legal / insurance attitude (for and against) is "take no prisoners, go with anything you've got".

They wouldn't be doing their jobs, otherwise.

And a courtroom can be a harsh place : ask any rape victim.

People bare their souls while posting on forums and blogs.

Some "anonymously", others by name.

And in the process reveal potential chinks in their armour and strategy, that the opposition will, *without hesitation*, pounce on.

Search engines have become *very* sophisticated, and yes, good lawyers (depending on your perspective) *use them* in this new cyber age.

Not just for names, but general context that could link to an upcoming case.

Anonimity is a fallacy.

Ask "Flea", a medical blogger who posted about his trial in progress.

I have to wonder the same thing. The only thing that I could see of benefit to me, if I should appeal the College's decision and a lawyer looked at my postings, is that they would see that I'm not quite as "unstable" as this doctor has painted me to be. (At least I hope that's obvious! Shocked Puzzled ) As well, as far as I'm concerned, they wouldn't be able to find any difference between what I reported to the College to what I have posted here. So, that would show that "if" I am a liar (like my chart shows me to be), at least I'm a consistent one! Sticking out tongue Eye-wink

Actually, you *should* be concerned about it because it's not like they would quote things in the context in which YOU meant them. Misquoting is what some lawyers learn to do quite well.

That is what Janice is so upset about and what originally had me upset when I got my decision. As far as the College is concerned, what is in our files is the only thing that counts. I could give the College all sorts of different "opinions" from different professionals . . . and I DID, but it didn't make a bit of difference. Do you want to talk about "mind-set" . . . the College looks only as far as what is in front of them and what is told to them by the doctor that is being complained about. I am going to elaborate a little on what I have written and you tell me your thoughts.

When I complained to the College that my ex psychiatrist (hereinafter referred to as my "ex") minimized my sexual abuse, I made mention about e-mails that I sent to him in which I pleaded with him to get me a referral with someone who had the "expertise" in sexual abuse issues. To give the short version, in my "fraudulent" file, there is no evidence of these e-mails, although my ex does admit to my having sent them.

He claimed that these e-mails were seen to be "irrelevant" to my care. As well, he indicated that I was too "unstable" to deal with these issues and it would have been detrimental to my well being. I have statements from both a psychologist and a social worker, who I was seeing during the same time frame as I was seeing my ex. They provided the College with a statement saying that at no time did they find me "unstable."

The e-mails and the other professionals' statements didn't hold a spark of interest to the College. You would think that they would have least phone or contacted these professionals and talked to them directly, to get a better feel for the situation. They didn't. What was in my file was the "God given truth" because my ex wrote it. It did not matter that I gave them a ton (a bit of exaggeration, but not much) of supporting evidence that if you stacked them one on top of the other would give credence to my claim of fraud . . . they tore each one individually so that it no longer held any weight. It's surprising how easy that they could do that. A twist of a word here, a somewhat pausible explanation there . . . and viola . . . the doctor was speaking the truth. Even though he had to retract statements that he made; making excuses as to why they didn't add up to the evidence.

Fair, Random . . . there is no "fair" when you are a psychiatric patient. I can tell you that here and now. What burns me the most, is I don't have a "psychiatric" disorder (other than PTSD), I have sexual abuse issues.

Are you sure? What if, after 3 days, the psychiatrist says that the patient is still a danger to him/herself or others? If they have the patient so medicated that they "can't" leave? What then? Puzzled Puzzled

Yes, if they had a lawyer the lawyer would be horrified but not for the reason you gave. It isn't that they know the law best, they can even be totally clueless about the law they are talking about; it is that they are schooled in, have learned and are well practiced in the tricks of the trade used to make them appear to know what they're talking about and to manipulate and trip up their opponents.*

*This is one of the main reasons why they can see through psychiatric testimony, that is if they want to be bothered and they think it to their or their client's advantage.

In the US there are courts called "Mental Hygiene Courts". There is a judge but the right to having your case heard by a jury has been stripped. For the most part, these courts give the appearance that due process is served and nothing more at best except in very rare instances.

No one can know what will specifically happen to them in the future. Even if someone is not now heading into the "lion's den" they may be pulled in at some other point in their life. No one plans on that happening to them. But happen it does.

I'll throw my big mouth in there, Ever since i found this site i've been running my mouth about Dr French. Nothing has ever been brought up in trial or my appeal, that i won, because i've only stated fact and provided alot of docs to back it.
I am only trying to provide info about him so people have the info to make a better decision about going to him.
My attnys have warned me about what i say and have advised me as what not to say.
State only fact and you'll be fine.

In thinking of what I have posted to date, I don't think that I have shared anything here on the forum that has not already been discussed with the College. I may have referred to myself as a "psychiatric patient" on occasion, but not in the context that I perceived myself to be crazy . . . but that there seemed to be a definite bais because of the "type of patient I was" when dealing with the College. In fact, I believe that when I was discussing anything about the case, it had to deal more with why I was so relucant to discuss my sexual abuse with my ex psychiatrist and this was made more believable when others posted about their own sexual abuse and the shame, guilt, humilitation, and most importantly the secrecy that went with it. In that my ex has me revealing this on my first visit with him, makes my contention that to do so, after years of hiding it, was not something that I would have likely done.

I also don't think that I have ever written anything slanderous about my ex, simply for the fact I had no reason to do so. Again, everything I wrote here has already been reviewed by the College.

I would certainly like to hear from anyone who thinks that they think that I have revealed too much. I, too, may be resorting to "smilies."
